Terms of Use

These Terms of Use ("Terms") apply to https://loanlens.ca, its calculators, guides, data pages and embeddable tools (together, the "Site"), operated by LoanLens ("LoanLens", "we", "us"). By accessing or using the Site, including through a calculator embedded on another website, you agree to these Terms. If you do not agree, do not use the Site.

1. General information only, not advice

The Site provides general information and estimating tools for educational purposes. It does not provide financial, investment, tax, accounting, legal, insurance, mortgage or credit advice, and nothing on the Site is a recommendation to buy, sell, borrow, invest or take any other action. The Site does not consider your personal circumstances.

LoanLens is not a lender, mortgage broker, financial institution, insurance agent, or registered or licensed adviser or dealer. Using the Site does not create an adviser-client, fiduciary, professional or any other special relationship between you and LoanLens. Before making a financial decision, consult a qualified professional who knows your situation and confirm details directly with the relevant lender, institution or government body.

2. Calculators, figures and content may be wrong or out of date

Calculator results are estimates based on the information you enter and on simplifying assumptions described on each page. They are not quotes, offers, approvals or guarantees. Actual rates, payments, taxes, benefits, fees and eligibility are set by lenders, institutions and governments and may differ significantly from any estimate.

Tax rates, contribution limits, benefit amounts, lending rules and product features change, sometimes without notice. Although we try to keep the Site accurate, content may be incomplete, contain errors, or not reflect the most recent changes, including after its "published" or "reviewed" date. Official sources listed on the Site are provided for convenience; where the Site and an official source differ, the official source prevails. You are solely responsible for verifying any information before relying on it and for all decisions you make.

3. No warranties

To the fullest extent permitted by applicable law, the Site and all content, calculators and embeddable tools are provided "as is" and "as available", without warranties, representations or conditions of any kind, whether express, implied or statutory, including any implied warranties or conditions of merchantable quality, fitness for a particular purpose, accuracy, completeness, timeliness, non-infringement, or that the Site will be uninterrupted, secure, or free of errors, viruses or other harmful components.

4. Limitation of liability

To the fullest extent permitted by applicable law, LoanLens and its owners, operators, contributors and service providers will not be liable for any loss or damage of any kind arising out of or relating to the Site or these Terms, including direct, indirect, incidental, special, consequential, exemplary or punitive damages, and including any loss of money, savings, profit, revenue, opportunity, data or goodwill, any tax, penalty, interest or fee, or any loss resulting from a financial decision, reliance on a calculator result or on any content, or an error or omission on the Site. This applies whatever the legal theory (contract, tort including negligence, statute or otherwise) and even if we were told such loss was possible.

If, despite the above, we are found liable to you, our total liability for all claims relating to the Site is limited to one hundred Canadian dollars (CAD $100).

5. Your responsibilities and indemnity

You agree to use the Site lawfully and at your own risk. To the extent permitted by law, you agree to indemnify and hold harmless LoanLens and its owners and operators from any claims, losses, liabilities and expenses (including reasonable legal fees) arising from your misuse of the Site, your breach of these Terms, or content you publish that includes or embeds the Site's tools.

6. Third-party products, links and advertising

The Site displays advertising served by third parties, including Google, and links to third-party websites. Mentions of financial products, institutions or providers, including on "best of" comparison pages, are general information only, are not endorsements or offers, and may not reflect current terms, rates or availability. Unless clearly labelled otherwise, we do not receive payment from the providers we mention. We do not control and are not responsible for third-party websites, advertisements, products or services, and your dealings with them are solely between you and the third party.

7. Embedding our calculators

We grant website owners a free, non-exclusive, revocable permission to display our calculators using the unmodified embed code we provide, provided the "by LoanLens.ca" credit link remains visible. You may not alter the calculators or their results, present them as your own or as professional advice, place them in a misleading context, or imply that LoanLens endorses you. Embedded calculators are subject to these Terms and are provided without warranty. We may change, restrict or discontinue any embedded tool at any time without notice, and you are responsible for your own website, including its disclosures and compliance with laws that apply to you.

8. Intellectual property and acceptable use

The Site's content, calculators, code and design are owned by or licensed to LoanLens. You may link to any page and quote short excerpts with attribution and a link. You may not copy, republish or sell substantial portions of the Site, or use automated means that degrade the Site's performance. Search engines and AI answer services may access the Site as permitted by our robots.txt file. You must not attempt to disrupt, damage or gain unauthorized access to the Site.

9. Privacy

Our Privacy Policy explains what information is collected when you use the Site and how it is handled.

10. Changes to the Site and these Terms

We may change, suspend or remove any part of the Site at any time. We may update these Terms by posting a revised version with a new "last updated" date; the revised Terms apply from that date to your continued use of the Site.

11. Governing law

These Terms are governed by the laws of the Province of British Columbia and the federal laws of Canada that apply there, without regard to conflict-of-law rules. You agree to the non-exclusive jurisdiction of the courts of British Columbia.

12. Consumer rights and severability

Some jurisdictions, including Quebec, do not allow certain warranty exclusions or limitations of liability, so some of the above may not apply to you. These Terms do not limit any rights you have under consumer protection or other laws that cannot be waived or limited by contract. If any part of these Terms is found unenforceable, it will be enforced to the maximum extent permitted and the rest of the Terms will remain in effect. Our failure to enforce any provision is not a waiver. These Terms, together with the Privacy Policy and Disclaimer, are the entire agreement between you and us about the Site.
